Terms of Use

These terms apply to the IMAGINE IT app ("the app"), published by Stadium Status Records ("we", "us"). By using the app you agree to them, and to Apple's Licensed Application End User License Agreement, which also applies.

1. What the app does

IMAGINE IT creates and edits images using open AI models that run entirely on your device. The models are downloaded from Hugging Face when you choose them. Results are generated by AI and may be unexpected or inaccurate.

2. Your images

Images you create are yours to use, including commercially, subject to these terms, the law, and the use rules of the models below. You're responsible for how you use what you create, including making sure it doesn't infringe anyone else's rights. AI-generated images may not be protected by copyright in every country.

3. What you may not create

The app blocks, and you agree not to attempt to create: nudity or sexual content; any sexual, suggestive or revealing content involving anyone under 18; images of real, identifiable people; content that harasses, defames or demeans people; hate symbols or extremist content; content promoting self-harm; and anything illegal where you live. Trying to get around the app's safety checks is a breach of these terms.

4. Mature mode

Mature mode is available to Pro members who confirm they are 18 or older. It allows adult themes such as swimwear and fashion photography, glamour, horror, and cinematic violence or gore. It never allows nudity, sexual content, minors or real people.

5. Model licences and use rules

The models are licensed under the CreativeML Open RAIL-M and Open RAIL++-M licences, which allow commercial use. As those licences require, you agree not to use the models or their output:

• in any way that violates any applicable national, federal, state, local or international law or regulation;
• to exploit, harm or attempt to exploit or harm minors in any way;
• to generate or disseminate verifiably false information and/or content with the purpose of harming others;
• to generate or disseminate personal identifiable information that can be used to harm an individual;
• to defame, disparage or otherwise harass others;
• for fully automated decision making that adversely impacts an individual's legal rights or otherwise creates or modifies a binding, enforceable obligation;
• for any use intended to or which has the effect of discriminating against or harming individuals or groups based on online or offline social behaviour or known or predicted personal or personality characteristics;
• to exploit any of the vulnerabilities of a specific group of persons based on their age, social, physical or mental characteristics, in order to materially distort the behaviour of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm;
• for any use intended to or which has the effect of discriminating against individuals or groups based on legally protected characteristics or categories;
• to provide medical advice and medical results interpretation;
• to generate or disseminate information for the purpose of being used for administration of justice, law enforcement, immigration or asylum processes, such as predicting an individual will commit fraud or crime.

6. IMAGINE IT Pro

Pro is offered as a monthly or yearly auto-renewing subscription, or as a one-time Lifetime purchase. Payment is charged to your Apple Account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; manage or cancel in your Apple Account settings. A free trial, where offered, converts to a paid subscription unless cancelled before it ends. Lifetime is a one-time purchase that unlocks Pro for as long as the app is offered. Refunds are handled by Apple.

7. The free plan

The free plan includes a limited number of creations per day, and saved or shared images carry a small IMAGINE IT mark.

8. No warranty

The app is provided "as is". To the fullest extent the law allows, we are not liable for indirect or consequential losses arising from your use of the app or its output.
